This information is intended for Owners, Realtors, and Title Companies that will be involved in change of owner transactions in Harmony Heights Subdivisions.
All lots in Harmony Heights Subdivisions are provided with culinary water by the Harmony Heights Water Company (HHWC). The Water Company is owned by stockholder property owners with most lots being appurtenant to two (2) shares of stock. Ownership of these shares of stock are transferred by including specific language on the deed. Instructions for recording HHWC share of stock ownership transfers are listed below and are available for download.
In addition, Harmony Heights Phase 2 is serviced by an irrigation water company, the Harmony Heights Secondary Water Association (HH Secondary). Each property owner in Phase 2 is also a stockholder in HH Secondary with one (1) share of stock appurtenant to the property. Again, share of stock ownership is transferred by including specific language on the deed. While these two companies are unrelated and have separate contact individuals, HH Secondary transfer instructions are included on this HHWC website for informational purposes and to make the transfer process as simple as possible for stockholders, realtors, and Title Companies. Instructions are listed below and are available for download.
HARMONY HEIGHTS WATER COMPANY
Instructions to transfer shares of stock in Harmony Heights Water Company (HHWC) for Culinary Water Services
I. Monthly Water Payments:
Monthly water payments must be paid up to date before the shares of stock can be transferred to a new owner. To determine if monthly water fee payments are paid up to date, please contact, HHWC Billing at Contact Us. In response to such a request, a spreadsheet will be provided that calculates the amounts owed by both the seller and buyer based on the closing date. The Title Co enters the closing date and all the values are automatically updated. (Note: Only the closing date cell is unlocked.) The spreadsheet is only good for the current month. Should the closing date be postponed into the next month, a new spreadsheet must be requested.
Note: Until all payments are up to date, the current owner(s) will be responsible to pay the monthly water fee charged on the lot. (Water to the lot may be disconnected if payments are not made in a timely manner).
II. Share of Stock Transfer Documents and Fees:
The following documentation and fees must be completed and returned to HHWC, before shares of stock can be transferred to a new owner. Most lots are appurtenant to two (2) shares of stock in HHWC.
- Buyer’s Warranty Deed. The Deed shall describe the appurtenant real estate located in the water company’s service area, which is appurtenant to the water company shares of stock. The shares of stock shall be conveyed by adding the following language on the deed:
“TOGETHER WITH two shares of stock in the Harmony Heights Water Company, which shares are appurtenant to the above-described real property.” - Billing address of new lot owner. If the new owner(s) would like a billing address different than what is provided on the warranty deed, provide the buyer’s mailing address. If a New Harmony address is listed, it must be a P.O. Box (mail is not delivered to a street address).
- Please contact HHWC to determine if Water Service has been connected to the lot.
Water Service is Connected: Complete and sign the Application to Turn on Water Service form together with a $100 fee.
Water Service is Not Connected: If water service is desired, complete the Water Service Connection form together with a $2,000 connection fee. Lots not connected to water service have a $48 monthly standby fee. - Transfer Fee of $35
Title Company Notes:
Ownership of water company shares transfer by recorded Deed only. Deeds without the language listed above will be returned for correction.
Since water company shares are appurtenant to the property the water is used on, which is located in the Water Company’s service area, this is done concurrently with the transfer/closing of the appurtenant property. There are NO water rights being transferred, only shares of stock in the Water Company. As such, a “Water Rights Addendum to Land Deeds” form, commonly used to transfer Water Rights (see Note N6), is not necessary. Best practice is to not use this form.
If a Title Company still chooses to use the form, the top of the form must only have a check next to box #3 (no water rights are being conveyed) and the “Other water related disclosures:” box of Section C should indicate, “A recorded deed of the appurtenant property gave notice to Harmony Heights Water Company to transfer two shares of stock to the grantee.” A copy of the form must be submitted to HHWC.

Harmony Heights Secondary Water Association
Instructions to transfer the share of stock in Harmony Heights Secondary Water Association (HH Secondary) for Irrigation Water Services
IMPORTANT SUBDIVISION VERIFICATION: These instructions are ONLY for the “Harmony Heights Phase 2” subdivision. Please verify that the lot being sold is in “Harmony Heights Phase 2” subdivision before using these instructions
The following documentation and fees must be completed and returned to HH Secondary before the share of stock can be transferred to a new buyer. All lots in the Harmony Heights Phase 2 subdivision are appurtenant to one (1) share of stock in HH Secondary
- Buyer’s Warranty Deed. The Deed shall describe the appurtenant real estate located in the association’s service area, which is appurtenant to the water association share of stock. The share of stock shall be conveyed by adding the following language on the deed:
“TOGETHER WITH one share of stock in the Harmony Heights Secondary Water Association, which share is appurtenant to the above-described real property.” - Billing address of new lot owner. If the new owner(s) would like a billing address different than what is provided on the warranty deed, provide the buyer’s mailing address. If a New Harmony address is listed, it must be a P.O. - Transfer fee of $25.00.

Informational Notes:
- Stand-by fee: A yearly use or stand-by fee is charged for all lots for the secondary water. Water is available, weather permitting, from April thru October. The fee amount varies from year to year as set by the Association’s Board. The annual fee is billed in April of each year and has been $125.00 in years prior to 2021.
- If Water Service has not been connected: If the lot does not have secondary water service connected, a Service Connection fee must be paid to have a meter installed to begin to receive HH Secondary water.
